Terms of Service

The terms that apply when you use our website and place an order. Diving is a high-risk activity — please read the safety and risk sections carefully.

1. Acceptance of Terms

These Terms of Service govern your use of the HOTDIVE website and your purchases from it. By using the site or placing an order, you accept these terms together with our Privacy Policy. The website is operated by Narwhal Technology (Dongguan) Co., Ltd., registered in Mainland China.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to purchase from us.

3. Account Registration

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account.

4. Products, Pricing & Availability

We make every effort to describe and display products accurately, but minor variations may occur. All products are subject to availability. We reserve the right to correct errors, change prices, and to refuse or cancel an order if a product is mispriced or unavailable; in such cases any payment taken will be refunded.

5. Orders & Contract Formation

Your order is an offer to buy. A binding contract is formed only when we send you a shipping confirmation for the relevant item(s).

6. Payment, Shipping, Returns & Warranty

Payment terms are set out on our Payment Methods page; delivery on our Shipping & Delivery page; returns on our Returns & Refunds page; and warranty on our Warranty page. These are incorporated into these terms.

7. Product Safety & Proper Use

Diving is a high-risk activity. Our equipment must only be used by appropriately trained and certified divers, in accordance with the manufacturer's instructions. Regulators, BCDs and other life-support gear must be checked before every dive and serviced regularly by an authorized technician. Our products do not replace proper training, and SCUBA cylinders and compressed gas must be handled in line with safety regulations.

8. Assumption of Risk

You acknowledge that diving carries inherent risks — including equipment-related risks, environmental hazards, injury and death — and that you assume these risks when diving. The sale of equipment does not constitute a guarantee of your safety while diving. Nothing in this section excludes or limits liability for death or personal injury caused by our negligence or by a defective product, or any other liability that cannot be excluded by law.

9. Intellectual Property

All content on this website — including text, images, logos and trademarks — belongs to Narwhal Technology (Dongguan) Co., Ltd. or its licensors and may not be used without our written permission.

10. User Content & Reviews

If you submit reviews or other content, you grant us a non-exclusive licence to use it in connection with our business, and we may moderate or remove content at our discretion.

11. Prohibited Uses

You agree not to misuse the website, including unauthorised resale, scraping, attempts to gain unauthorised access, or any unlawful activity.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the website or products. Nothing in these terms excludes or limits any liability that cannot be excluded by law, including liability for death or personal injury, fraud, or your statutory consumer rights.

13. Disclaimer of Warranties

The website and its content are provided "as is", without prejudice to your statutory rights, including the 2-year legal guarantee of conformity where applicable.

14. Governing Law & Jurisdiction

These terms are governed by the laws of the People's Republic of China (Mainland), and disputes are subject to the competent courts of Mainland China. If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection laws of your country of habitual residence.

15. Dispute Resolution

We aim to resolve disputes amicably — please contact us first. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Force Majeure, Severability & Changes

We are not liable for delays or failures caused by events beyond our reasonable control. If any provision is found unenforceable, the remaining provisions stay in effect. We may update these terms from time to time; the "last updated" date reflects the current version.
